G.W.S. Barrow lists Gilbert as the earl of Angus from 1267presumablyonthedeath of the previous incumbent Gilchrist unless thetitlewastemporarilytaken away from him. Other sources claim thetheUmfrevillesheld theEarldom from 1243 or from 1245. Gilbert's motherMaudwas thedaughter ofEarl Gilchrist and Maud the sister of WilliamKingofScotland.

Gilbert married Elizabeth the daughter of Alexander Comyn,EarlofBuchanand produced 3 sons. The eldest, Gilbert (diedearly,before1307)married Margaret De Clare. The second son who became thenextEarlwasRobert. The third son Thomas became a knight at thecourtofeitherEdward II or III and may have had descendants in thesouthofEngland.

Gilbert alienated Chollerton in about 1268 and sold itin1274.TheInspeximus Maximus of 1298 lists the donation ofCholvertonChapel tothePriory of St Andrew's at Hexham by Odonell DeUmfreville,mostlikelyGilbert's uncle Odonell. We know that Chollerton andBirtleyhadbeenreleased to him by Richard of Chollerton which may meanthatOdonelldiedbefore 1274 if Gilbert was able to do with it what hewanted.

On June 13th 1291 Gilbert was at Upsettlington Nr Norham CastleontheriverTweed with the Guardians and magnates of Scotlandtoswearindividual fealtyto Edward I. Earlier that year Gilbert hadrefusedtosurrender the castlesof Forfar and Dundee, which were in hiskeeping,toEdward declaring that hehad been entrusted them by thecommunity oftherealm of Scotland and notthe King of England. Gilbert didhand themoverat this meeting. EarlGilbert is known for his stubborness;hesofrequently exceeded hisauthority within Redesdale that in 1293hewasbrought before Newcastleassizes and the followingchargesbroughtagainst him:

I) That he erected a gallows at Alwinton without licence from the crown.II) That his Bailiffs fined both those that appeared andthosethatfailedto appear before his courts whether they lived in theLibertyornot.

III) That he did seize the cattle of a John of Hirlaw forgrazingoncommonland, sell two of them and had three more for his kitchen.

In his defence Gilbert claimed that only he or his justicescoulddealwithcases within the Liberty. He claimed a river crossing taxatElishawon theScots border which he said he only exacted fromScotsmen!Gilbertarguedthat the wardenship of the Liberty entitled himtomanyprivileges, forexample, all legal cases concerning the Libertyweretobe heard in hiscourts before his Justices; he could freecriminalsfromhis gaol atHarbottle castle and deal with injusticesconcerningtheinspection ofbread and ale. He claimed the right to hold amarketatHarbottle everyweek on tuesdays and hold an annual fairon8thSeptember. He could alsohold a sunday market at Elsdon andanannualfair there on 16th August. Gilbert was summoned to the EnglishParliament in 1296 and in1298heaccompanied Edward I on his militaryexpedition to ScotlandtofightWilliam Wallace at Falkirk (22nd July). In1306 he was one oftheScotsEarls opposed to Robert Bruce who had justseized the crownfromJohnBaliol. Gilbert died in 1307, the same year asKing Edward. Itishistomb cover that resides in Hexham Abbey.

Gilbert produced 4 offspring:

Gilbert (c. 1275 - bef. 23/5/1303), Robert (c. 1277 -30/3/1325or3/4/1325poss death and burial dates), Thomas'ValectusRegis'(KingsSteward?) (c.1279 - c. 1340) and a daughter(b. c.1281) who diedinWoodburn Lincs and was married to John De LisleofWoodburn.
