The low hill of battle.

According to Frank C. McElvain, NIGEL MACYLVEYNE livedfrom1395-1465,andis credited by tradition with being the founder oftheestates ofGrimmet, although, as we have seen earlier, the family mayhaveheldestates in thearea from a much earlier time. He is broughtintotherecords in aconfirmation of the lands of Grimmet and AttiquinbyKingJames of Alan, son of Gilbert MacYlveyne in June 1529.Thisrecordconfirms the tenancyof.the family dating to the non-entryofNigel.Whileno definitiverelationship to Nigel is given, it is presumedthat hewasthe father ofGilbert. It does not seem rea~nable thatthenon-entrywould have dated toa previous Nigel several hundredyearsearlier. Someauthorities assertthat Nigel was the son of aGilbertMacYlveyne.

Darrel Iwerks reports that King James I succeeded to thethroneofScotlandin April, 1406, on the death of his father RobertIII.James, then aged 7.had become heir to the throne four years earlier.InMarch,1406, only amonth before his death, Robert III decided thatJameswouldbe safer inFrance, but the young prince was captured at seabytheEnglish. King Jamesremained a prisoner king in England for18years,while first his uncleAlbany and later his cousin MurdacactedasGovernors of Scotland. At lastin December, 1423, a treaty wassignedinLondon by which James was allowedto return to his kingdominexchangefor a large ransom, the payment ofwhich was to be guaranteedbywealthyhostages. Twenty-seven of these weresent to Englandimmediatelybutexchanges were made at regular intervals.Among those sentsouth in1432was Nigel MacYlvayne. The hostages weredetained either at thetowerofLondon or at one of the other castles, where they lived attheirownexpense with retainers and servants who wereallowed to travelfreelytoand from Scotland. On the payment of theransom, allreturnedtoScotland.

Most authorities agree that Nigel had at least twosonsGilberto, whosucceeded him as heir, and John. John was shown as awitnessinDumfries,1477. He probably married a Miss Kennedy, sisterofGilbertKennedy, Earlof Cassilis. There is some question whether thisisthe sameJohnMakilvane who appears in court documents from 1503-1516.Thelaterdateslead some researchers to believe that he may havebeentheyoungerbrother or cousin of Alan. The Glasgow CommissariatOctober15,1515cites John Makilvane et al for the slaughter of JamesDouglas, andheismentioned in the records of Ayrshire and Carrick as earlyas1503andlater in 1512, 1516, and 1524. He is not named in anyoftheearlyconfirmations of the grants of Grimmet and Attiquin, eithertoGilbert,Alan, Gilbert, or Patrick.

In the PBGR # 1044 Gilbert Kennedy of Kirkmichael, compearingintheTolbooth of Air before Charles Campbell, Macer of theSheriff ofAir,inthat part especially constituted in the causeofrecognitionbetweenGilbert and Allan M'Ylveyne, protests thatwhatsoevershall bedone insaid cause before said judge, shall notprejudice DavidM'Ylveyne,a sonof Gilbert's sister, as to the right he hasin the landsofAttiquin. The'young Laird of Attiquin' reported in recordsas killedin1512 had beena Kennedy. It is possible that his interestpassed tohissister, andfrom there, by marriage, to the Lairds of Grimmet.
