Will of Elisha Strickland Transcribed by Elizabeth Periman Dated February 23, 1795 Proved September Term, 1795 Wake Co., North Carolina, Will Book D, p. 173 In the name of God Amen I Elisha Strickland of Wake Co., and State of North Carolina being in Perfect mind and memory thanks be given unto God Calling into mind themortality of my body and knowing that it is appointed for all men onceto die do make and ordain this my last Will and Testament that is tosay Principally and first of all I give and Recommend my Soul into thehand of Almighty God that give it and my Body I Recommend to the earth tobe buried in a decent Christian burial at the discretion of my Executors nothing dobting but at the General resurrection I shall Receive thesame again by the mighty power of God and as touching such worldly Estates Wherewith it has bin Please God to bless me with in this life I give demise and dispose of the same in the following manner and form FirstI give to my dearly beloved son Kinchen Strickland the maner plantation where I now Live Containing by estimation three hundred akers Lying on both sides of Mokerson Creek one Negro woman Named Hanner one Negrogirl Named Vilet and one Negro Boy Named Croel one Mair Saddle andBridles one Bed and furneture and all my Cattle but one Cow and Calfthat that I Leve to my Gran Daughter Milbre Strickland Also I Give tomy son Isaac Strickland Two Hundred and Fifty akers of Land Lying inthe fork of Mokerson it being the Plantation where he now lives. Herein fall not. Witness Simon Turner,Clerk of the said Court at his office in Raleigh, the fourth Monday ofJune 1805 and in the 29th year of American Independence July 10, 1805. signed S. Turner, C. C. On reverse side of above paper: Brasel Strickland & Wife, suponeaIsaac Strickland and others to Wake, August Term 1805. Executed on allexcept Jacob Wray, who it is said is deceased. State of North Carolina, Co., of Wake, Court of Pleas, QuarterSession, June 1805 The petition of Brasil Strickland & Polly his wife-- Your petitioners humbly state that Elisha Strickland, father of Polly,one of your petitioners died about fifteen years ago. That one IsaacStrickland produced soon after his death a paper writing purporting tobe the last Will and Testament of said Elisha and wherein the saidIsaac was named Executor and caused the same to be proven in thisCourt in the common form without giving notice to the next of kin ofsaid Elisha and without the knowledge of your petitioners. That bydec'd papers bequests were made to the following persons, children ofsaid Elisha, but by no means in equal proportions. To JacobStrickland, who lives in Anson Co., NC; to Priscilla Stricklandintermarried with Jacob Lewis?, which said Jacob Lewis lives in theState of GA; the said Priscilla being dead, having six children livingin the State of GA whose names are to your petitioner; CharityStrickland intermarried with James Johnson residents of GA; Elizabethintermarried with Hardy Griffin which said Elizabeth is dead, havingfour children to wit: James, Jincy, Jenny and Isaac, residents ofI_nklin; Isaac Strickland living in GA; Polly Strickland intermarriedwith Brasil Strickland, your petitioner; Sally Strickland intermarriedwith John Pace living in Franklin; Kinchen Strickland lives in GA;Milly Strickland intermarried with William James? residents ofFranklin. Your petitioner states that they are informed and believe that thesaid paper writing is not the last Will and Testament of said Elisha.They are informed also and believe that should the said paper in otherrespects be the last Will of said Elisha, that Legacy given to MillyStrickland was fraudulently inserted, it being the intention of theTestator to give the legacy to Polly, one of your petitioners. Yourpetitioners humbly pray that the executor of said paper be in a solemnmanner examined and set aside, if not (the last Will and Testament) ofsaid Elisha--and to that end that copies of this petition to allparties concerned: Suponeas for the subscribing witnesses signed L. Hu for Petitioners Back of above reads: Brasil Strickland &Wife petition to set asideWill Brasil Strickland & Wife by Isaac Strickland & Others Petition to set aside the probate of a paper writing purporting to bethe last Will & Testament of Elisha Strickland. It appearing to the Court that the following defendants reside beyondthe limits of the state to wit: Jacob Strickland and his children,names ; James Johnson & Charity his wife, Isaac Strickland & KinchenStrickland. It is ordered that they appear on the first day of nextTerm and meet the intention of the above order in the North CarolinaMinutes be denied sufficient notice.
