(Research):Q Now, give the name o£ the children that survived your father beginning with the holdes? A Well, the oldost is Sophia Westphal. Q Give her name now? A Sophia Ort. Q A daughter? A Yes. Q Living where? A Living at Middleton. And then the re is Charlie Westphal, son, living at Verona; and Henry Westphal, son, also living at Verona and John Westphal, son, living at Middleton and Louis Westphal, son, living at Middleton, and next is Myself, Rudolph Westphal, son, Middleton; and James Westphal, son, at Middleton; next is Emma Rowley, a daughter, Middleton; Gusta Walters, living at Cross Plains, daughter. Q They are all of full age now? A Yes. Q And they are all living? A All living; all but Fred. Q They are all living to your knowledge except Fred? A Yes; of course we don't know. Q Now, how old would Fred Westphal be if he were living? A He must be about fifty-five. I think I have his exact age in a book. Now, when did he leave the homo of his father? A Well, that I couldn't exactly teil you how long it is but it must be somewhere around thirty-threo or thirty-five years ago. Q And Where did he go? A He went from the re to Nebraska - I guess he went to Minnesota first but ho went to Nebraska afterward. Q Havo you uny idea how long he remained in Minnesota and in Nebraska? A Well, not very long. If I can remember I don't think he was there a year unless any of the rest remember. Q Where did he go from Nebraska? A I think he went to Colorado; that is the first I heurd of hin afterward. Q Now, during this time did he correspond with any members of the family? A Hot very much; of courso he wrote once in a while. I remember the last letter he wrote he used to write every three years or so and then he would write that he was coming home for Christmas and that is about as far as it went. Q Who did he write to? A Well he wrote to different ones. Pretty near all of them first when he left. Q So far as any of the letters that you saw did they evidence friendliness to the brothers and sisters? A He always was friendly to everyone. Q You know of nothing or have heard of nothing that would caused him to hold any grievance against the brothers and sisters? A No, not at all. Q What were his expressions in his letters with reference to his mother? A Well, he would always write to his mother and give her bost regards and he would be home for Christinas to see her. Q In any of the lottere that you know of did he make any mention of being married? A Never. Q Or having any wife or children? A No; never did. Q What work was he engaged in so far as you know? A Well, he worked in the mines, ho claimed. Now, of course what mines, of course, I don't know myself. He always had wrote in some of his letters first that he had a share in some of the mines there. Of course, I don't know. Q Did he speak in any of the letters of being in poor Health or anything of that sort? A Never. Q Now, when did you last hear from him? A Well, it is a great many years ago when I heard from him last. I know it is over twenty years ago. Q COURT: What was the last letter that was received from him by any of his brothers and sisters or mother as far as you know? A Well, the last one is right there now. Mrs. Walters here it COURT: Lated Cripple Creek, Col. Feb. 2nd,19012 A Yes. Q That was written to his sister Augusta? A Yes. Q And, so far as you know, have any of his brothers and sisters or his mother received any letters from him since this one? A No. Never received none from him since that, I am pretty sure, not from Fred himself. Q If any of them had received them you are in such contact and terms with them that you would have learned about it? A I would have knew it; yes.
