GILBERTO M'ILVENE succeeded his father in possessionofGrimmetandAttiquin. He had confirmation of Grimmet from Queen Mary5-4-1546 as son and heir of Alan.Gilberthadseveral sons of whom Patrickis the only one proven. Other sonsmayhavebeen David, Gilbert, Oliver, andThomas. Some searchersbelievethatDavid was the heir, but that heabdicated in favor ofPatrick,whomarried a Kennedy and was able toretrieve the familyfortunes.

Gilberto was a Colonel of horse and eventually died in thebattleofFawsidenear Edinburgh, September 18, 1547. His name is includedinalist of thegentry who fell in the battle, as publishedbyPaterson's'History of Ayrand Wigton.' Hanna's History mentionsGilbertas 'LairdMaclevens.O Thefollowing excerpt from 'Lion in theNorth', byPrebble,describes the battle'The Battle of Fawside was foughtat Pinkie,sixmiles south-east ofEdinburgh. When the French leftScotlandafterhelping the Scots reclaim St.Andrews, eighteen thousandEnglishmencameover the border under Hartford,now Duke of Somerset andProtectorofEngland by his own making. Sixthousand of them were cavalryandeighthundred of the foot were musketeers;There were fifteen piecesofheavyartillery, a thousand wagons, and anattendant fleet tackingupthecoast. The return of an old and terribleenemy brought abriefanddefiant unity to the Scots. On Black Saturday,September 18,1547,Arranformed a battle-line of four divisions at Pinkie.The Scotshadnomusketeers, only spears and archers. Pride was againthegreatestenemyof the Scots and would lead them to their owndestruction.Infivehundred years the number of decisive battles they hadwon against the English could be counted on one hand, leaving a finger ortwo towagincaution. Pride and over- confidence had lost them the rest,anditwould beso again.'

Reg. Sig. Edinburgh, Vol. I, pg 136 is an extract of thepassingofthelands to Patrick heir of Gilbert McIlvane de Grumet, hisfather,whodiedunder his Majesty's Banner in the Battle of Fawside.Three-merklandsofNether Grumett and Three-merk lands of Ovir Grumett 6merk, Ipound,6s,8d lands of Attiquin in the Earldom of Carrick. DatedOct. 25,1547.

In 1548 the Exchequer of Rolls of Scotland, Vol. 18, pg438,showscertainconcessions made on monies due on death of those killedinbattleofFawside. Patrick had been granted the lands, as noted above,butbythisdocument life rent of 3 merklands of Net11er GrommetwerereservedtoJanet Corrie, Patrick's mother, widow of Gilbert. Life rentwasgiventoAllan Makelayne, his grandfather, of the 6 merklandsofAttyquinandfreehold rights to Mariote Ferguson, wife of Allan, incertainlands.

He was confirmed of Grimmet by Queen Mary 4 Apr 1546 as sonandheirofAlan. Gilbert had several sons of which Patrick is theonlyoneproven.Other may be David, Gilbert, Oliver and Thomas.
