The parties are neighbors with a history of disputes over their farm properties. Respondent Terfehr and others claimed appellant Kleinfehn had deliberately blocked a common ditch used by the parties, causing damage to Terfehr's crop land. Kleinfehn contended Terfehr and others had failed to comply with previous court orders directing the common ditch be unobstructed, thereby causing him loss of crop land. The trial court found Terfehr in compliance with and Kleinfehn in violation of its previous court orders, and awarded Terfehr damages. Kleinfehn appeals.
Bert Terfehr, age 86, of Osakis, Minnesota, passed away Thursday, February 15, 2001 at his daughterﾒs home in Sauk Centre, Minnesota. Norbert John Terfehr was born on November 25, 1914 in Effington Township, Otter Tail County, Minnesota to Frank and Rose (Bitzan) Terfehr. He attended country school and worked on the family farm. On August 22, 1939 Bert married Margaret Sauer in West Union. They raised four children while Bert continued his lifelong love of farming. Margaret died in April of 1980 and later that year Bert retired. On August 17, 1981 he married Rosena Zimmel Schlosser. Rosena died on May 8, 1985. Bert kept busy helping his son John with the farm work and tending to his garden. He enjoyed getting out with his friends for a good game of pool or card playing. Going out dancing was another of Bertﾒs favorite pastimes. Bert was a member of St. Alexius Catholic Church in West Union and belonged to the St. Joseph Society. He is survived by his sons: John (Jan) Terfehr of Sauk Centre; Mark (Deb) Terfehr of Brooklyn Center; daughters: Joyce (Jerry) Klimek of Osakis; Susan (Mick) Engle of Sauk, Centre; stepchildren: Anita (William) Hintzen of Carlos; Yvonne (Darwin) Zavadil of El Cajon, CA; Pat Sorenson of Alexandria; Joyce (Knute) Hammerberg of Owatonna; seven grandchildren; 15 step-grandchildren; eight great-grandchildren; 19 great-step-grandchildren; a brother, Bill (Elaine) Terfehr of Urbank; four sisters: Theresia Miller of Kansas City, MO; Magdeline (John) Politeski of Lake Lenore, Saskatchewan, Canada, Alma Revering of Fergus Falls, Frances Sauer of Osakis; and many nieces and nephews. He is preceded in death by his parents; wives, Margaret and Rosena; grandson, Todd Engle; stepson Cecil Schlosser, Jr.; brothers, Al and Ray Terfehr; and sisters, Clara Turchin and Joan Slye. Active pallbearers were grandchildren Jeff Klimek, Jennifer Samuels, Mike and Dustin Engle, Doug Terfehr and Kristine Hawkins.
