Last will and testament of Abraham Stauffer March 11th 1800
Heading: will of Abraham Stauffer, dicd. letters testimony granted to John Stauffer and Jacob Stauffer sons of deceased. Executors therein named. They being first duly qualified thereto. 11th March, 1800.
In the name of God, Amen I Abraham Stauffer of Coalbrookedale Township in the county of Berks and State of Pennsylvania Yeoman being very sick in body but of sound and disposing mind memory and understanding praise be the Lord for the same do hereby make my last will and testament, in the matter following that is to say-
First I will that all my just debts and funeral expenses Shall be duly paid and satisfied
Item I give onto my dearly beloved wife Sussannah the room with the stove and pipe therein at the northerly end of my house wherein I now reside, which must be divided for her into rooms by a partition, the garret above it with the little garden,liberty in the kitchen seller and spring house as much as she hath occasion for, and of passing and repassing wherever she hath occasion for. And the owner or occupier of my plantation shall keep her one cow in pasture in summer and in stable and fodder in winter with as good as his own cows and when she is not able to milk the cow herself, shall cause the cow to be milked, and have the milk put up for her use. And when the cow stands dry shall furnish her with milk as much as she hathoccasion for,for her use shall find her good and sufficient firewood hauled to the door and made small fit for immediate use, and give her yearly and every year one hundred pounds of good pork, fifty pounds of good beef, twelve bushels of grain,half wheat and the other half ry ( if he gets any quantity of wheat, otherwise the whole quality in rye). The swingled flax of one quarter acreof well manured and tilled flax sand, which shall be manured off for her every spring as it it sowed. Apples as much as she hath occasion for, for eating and dried apples, 1 barrel of cider if there are sufficient apples growing on the place. And further by executors hereinafter named shall pay her yearly the interest of three hundred pounds in gold or silver lawful moneyofPennsylvania, which some is to remain on interest from the first payment of my plantation (or if paid be placed out on interest) to hold the same to her my said wife Sussanah during her natural life, if she so long remains my Widow but in case she should intermarry again, then from and immediately after her intermarriage the whole what I have herein before given her, shalldetermine and in lieu and stead thereof I give her one quantity of twelve pounds in gold and silver lawful money of Pennsylvania, to commence from the day of her intermarriage and to be hadand received by her during her natural life. And I do hereby charge my estate with payment of said annuity and I will and declare that what I haveherein given unto my said wife, is inShall be in lieu and full satisfaction of her dower for thirds out of my whole estate, a real and personal and not otherwise.
Item I give an divide on to my son Henry Stauffer all my plantation and tract of land whereon I now reside containing about one hundred and fifty acres more or less, strict measure with the appertenances ( excepting nevertheless a certain part thereof which I have hereinafter devised to my son Jacob) of which is to take possession the spring next following after my decease, upon the following condition Èö viz. shortly before he takes possession of a plantation, three impartial and respectable freeholders of the neighborhood the shall be chosen in the following manner viz. my shall appoint one of them, my said the son Henry one other of them, and if both parties cannot agree as to the third of them - the two men appointed shall nominate the third man who, or any two of them, are hereby directed and empowered to value and appraise the same, and they shall fix as well the whole amount, what he is to have it at, as the terms of payments, but both are to be moderate, tohold the same to him the said Henry Stauffer his Heirs and assigns forever, subject nevertheless to the annuity herein before given theirat on to mysaid wife Sussanah.
Item I give and devise unto my said son Jacob Stauffer, a certain part of my plantation including one half of the field viz. the upper and adjoining his other land and including that partof the Woodland which lays south westward from a straight line, beginning at the northerly corner of said Fields and from thence to a corner of the said Jacobs StaufferÔÇÖs other land lyingnear the roadside also a piece of Woodland lying westerly from a straight line beginning at the last mentioned corner and from thence to the westerly corner of Abraham BuckwalterÈÇÖs landwith the appurtenances, of which he is to take possession the spring next following after my decease, And is to be valued in the same manner like my son Henry's, and themen shall have thesame power in saying of the amount he shall pay for its as well as the terms of payment, but both are to be also moderate to hold the same to him the said Jacob Stauffer for his heirs andassigns forever - provided that the present devise shall not effect nor alter the privilege of using the water as reserved by me from a grant of a tract of land which I made unto him heretofore.
Item I moreover give onto my wife Sussannah the bed which we made use of for us Èì[At this point, and for no apparent reason, there appear the signatures of Peter Richards, Jacob & Hans Cosionuooman [?], and another which cannot even be deciphered]Èìbedstead with curtains and bed cloaths sheets belonging to it, and also one table, one chest, two chairs, kitchen furnitureas much as she hath occasion for, and one [?] the choice of my whole stock.
Item I give on to Miami son Henry all my blacksmiths tools before hand.
Item is my will and do hereby order that (after deducting what is herein given and bequeathed) the rest and residue of my whole estate shall be equally divided amongst all my children viz. to John Stauffer, Daniel Stauffer, Margaret ( the wife ofJohn Kindig), Jacob Stauffer, Elizabeth (the wife of Jacob Meyers), Maria Stauffer, and Henry Stauffer, share and share alike provided that at the time when the first payment of my land is divided amongst same they shall all be made even, and have deducted out of their shares what they may have received of me respectfully during my lifetime, and that in receiving their shares of the payments afterwards arising out of my lands, they shall receive their shares respectively according to seniority to hold the same to them, their heirs and assigns respectfully forever.
And lastly I constitute and appoint my two sons namely John Stauffer and Jacob Stauffer to be the executors of this my last will and testament containing this and the annexed sheet which I have also subscribed before witnesses, empowering and authorizing my said the executors, or the survivors of them to execute a Deed of Conveyance to a certain John George Dreshe for a tract of land that I committed to convey to him, over the mountainous and do and perform every other thing needful or necessary to be done touching my estate for me and in my name in as fulland ample a manner as if I was personally present.
And I do hereby utterly disallow revoke and disannull all and every other former testaments, wills, legacies and executors by me in any way before this time named willed and bequeathed ratifying and confirming this and no other to be my last willand testament. In witness whereof I have hereof set my hand and seal this fourth day of August in the year of our Lord one thousand seven hundred and ninety nine.
Signed, sealed, published pronounced, and declared by the said Abraham Stauffer as his last will and testament, in the presence of [signatures of Peter Richards, Jacob & Hans Cosionuooman[?], and another which cannot even be deciphered]
Notation at the end: Registrar's office Reading Berks County March 11th A.D. 1800. There appeared Jacob Bauman and Isaac Bowman witnesses to the foregoing will [?] being duly affirmed according to law respectively did declare and say that they were present together and did see and hear Abraham Stauffer the testator herein named sign seal and publish and declare the same a writing to be his last will and testament and at the time of his doing that the said testator was of sound mind and memory and understanding to the best of their knowledge as they verily believe and further that the named Jacob Bauman and Isaac Bauman are of their own [?] writing respectfully thereto subscribed as witnesses in the presence of each other and inthe names of each other in the presence of and at the request of said testator.
