Following the death of her first husband, it appears Darby Downey wasappointed guardian of her children. In the June, 1837, term of theCourt of Common Pleas for Logan County, Ohio, Rebecca Starbuck made"petition for dower" and the court ofdered "one full equal third partof the lands in the petition described" be set aside for her. In Apr 1841, James W Marmon, administrator of Samuel Starbuck broughtto court a "petition to sell land" with "Rebecca Starbuck and others"as defendants. At that same court session, Darby Downey appearedagainst "John Sloan & wife & others". In the Apr 1842 session be find"Darby Downy v John Sloan, Rebecca Sloan, Leroy B Starbuck, Jospeh DStarbuck, in chancery": "John Sloan and Rebecca his wife Leroy BStarbuck Joseph D Starbuck George W Starbuck ordered to deliver goodand sufficient deed to Darby Downey for... Virginia Military Survey#4493 .. beginning at a stake by the side of a prairie thence south 70degrees W 154 poles to a stake on top of a rise thence south 38degrees E 95 poles to a white oak and black oak thence N 67 degrees E133 ples to stone thence N 20 degrees W 88 poles to the place of beginning containing by estimation 77.5acres."
